POSH Act Compliance

As per sub-section (1) of Section 26 of the Act, Where an employer fails to constitute an Internal Committee under sub-section (1) of section 4 or does not take action under section 13, 14 and 22; and contravenes or attempts to contravene or abets contravention of other provisions of this Act or any rules made thereunder; the employer shall be punishable with a fine which may extend to fifty thousand rupees for the first time, and if the offence is repeated could even lose the business license. Being a very recent act, not many establishments and employers are aware about the provisions of this act and unknowingly could be infringing on the provisions of this act.

SHAURYA is led by a team of Ex-Defence officers who are well acquainted with the provisions of this act and also have adequate knowledge and experience in handling these matters.

IT IS MANDATORY TO HAVE AN INDEPENDENT MEMBER ON THE INTERNAL COMPLAINTS COMMITTEE AND THE LATEST TERMS OF SUCH NOMINATION ARE AS UNDER;

  1. Constitution of an internal complaints committee and empaneling an independent member from a NGO is one of the most important parts of POSH act compliance. SHAURYA helps corporates comply with this provision of the POSH act by nominating one of its members as an independent member

of Internal Complaints Committees.
